The residential real estate game is changing yet again in Indiana—it keeps happening! For any of you that have bought or sold a home, you’re familiar with the Sellers Residential Sales Disclosure. It’s that two page grid-looking document, with allll the tiny check boxes. This is where the seller discloses their best current, actual knowledge about the property.
This document is created and updated by the Indiana Professional Licensing Agency and the Indiana Real Estate Commission. The new updates come as a result of several recent changes to state law and ongoing general review of the form. It’s required and issued by the State of Indiana.
Any active listing since July 1, 2025 SHOULD have this new and updated form filled out by the owner, unless you’re in an excluded category, which your favorite local Realtor can explain. Incase you’re wondering, a few categories that are NOT excluded include for sale by owners (yes, they need it) and property owners who have never lived on site (yes, they also need it.)
A few highlights of the added questions include locally designated historic districts, shared driveways, homeowner assessment amounts, and more.
We now have a spot on the disclosure form for sellers to add the age of their mechanicals, if known.
As always, this form is an opportunity for the seller to share their current actual knowledge as of the date that its filled out. Prospective buyers and owners are always encouraged to obtain professional advise or inspections of the property and provide appropriate provisions in the contract.
